Refund & Cancellation Policy

This Refund & Cancellation Policy applies to purchases made from TOF Software, a trading name of The Ork Forge Ltd.
Our products are primarily electronically supplied software licences and other forms of digital content.
This policy does not affect your statutory rights.
Digital Products
Software licences, activation keys, digital subscriptions and other electronically supplied products are treated as digital content where applicable.
Because digital products can often be supplied immediately and cannot practically be physically returned once a licence or activation entitlement has been issued, different cancellation rules apply compared with physical goods.
Your Right to Cancel Before Digital Supply Begins
Where you are purchasing as a consumer and digital supply has not yet begun, you may have a statutory right to cancel your purchase within the applicable cancellation period.

If your order has not yet been supplied and you are legally entitled to cancel, we will process the appropriate refund.
Immediate Digital Delivery
Where you request immediate supply of digital content, we may require you during checkout to:

Expressly consent to digital supply beginning immediately and before the end of the statutory cancellation period; and

Acknowledge that once digital supply begins, you will lose your statutory right to cancel the purchase.
Once you have provided that consent and acknowledgement and digital supply has begun, you will normally no longer have the statutory right to cancel simply because you have changed your mind.
Digital supply may include issuing, displaying, emailing or otherwise making available a software licence, activation key, download entitlement or equivalent digital product.
Change-of-Mind Refunds
Once digital content has been supplied following the required consent and acknowledgement, we are not normally able to provide refunds merely because:

You changed your mind;

You no longer require the software;
-
You purchased the wrong product;
-
You purchased the wrong licence duration;
-
You purchased a licence for the wrong operating system or platform where compatibility was clearly stated;

Your device does not meet clearly stated system requirements; or
-
You have not subsequently used or activated the supplied licence.
We therefore strongly recommend checking the product description and system requirements before completing your purchase.
If you are unsure which product you require, please contact us before ordering.
Nothing in this section removes any statutory rights you may have.
Faulty Digital Content
Your statutory rights continue to apply even after digital content has been supplied.
If software or digital content supplied by TOF Software is faulty, not as described or otherwise does not conform to applicable consumer law, please contact us at lewis.moore@theorkforge.com.
We will investigate the issue and, where appropriate, may work with the relevant software publisher or distributor to resolve it.
Depending on the circumstances and your statutory rights, remedies may include:

Repair or correction;

Replacement;
-
A price reduction; or
-
A refund.
The appropriate remedy will depend on the circumstances and applicable consumer law.
Activation Problems
An activation problem does not necessarily mean that a software licence is faulty.
Before requesting a refund, we may reasonably ask you to provide information necessary to diagnose the issue, such as:

Your order number;
-
The error message received;
-
The operating system being used;
-
Relevant software version information; and
-
Confirmation of the activation steps attempted.
Please never send us passwords or unnecessary sensitive information.
If we determine that the licence supplied is invalid or unusable through no fault of the customer, we will take appropriate steps to remedy the problem in accordance with your legal rights.
Duplicate Orders
If you accidentally place a duplicate order, contact us immediately.
Where the duplicate digital licence has not yet been supplied, we will normally be able to cancel the duplicate order.
Where both licences have already been supplied, the availability of a refund will depend upon the circumstances, including your statutory rights and whether the relevant licence can legitimately be revoked or recovered.
Orders We Cannot Supply
If we accept payment but subsequently cannot supply the product you ordered, we will refund the amount paid for the product we cannot provide.
Suspected Fraud
Refunds may be temporarily delayed where reasonably necessary to investigate suspected fraud, unauthorised payment or abuse.
This does not remove any statutory rights or refund entitlement that you may have.
How Refunds Are Paid
Where a refund is due, it will normally be made to the original payment method unless another method is agreed or required.
We will process refunds without undue delay and within any timeframe required by applicable law.
Your bank or payment provider may require additional time before the refunded amount appears in your account.
